The Time Has Come the Walrus Said...Australia and illegal Boat People

George Brandis said the retrogressive, undemocratic Section C of the Discrimination Act will be redefined (that’s polispeak for abolished) to allow for free speech regarding ethnic matters. Of course the ever-predictable Left went into a turbocharged spittle of “racism”. 

But George wasn’t alluding to free speech regarding Greeks, Italians, Chinese or even Aborigines. He was talking about tackling Islam, and it’s hard to tackle any emergency if you can’t talk about it.

Every section of the media has been forced to tippy-toe around naming Islam as Australia’s only clear and present danger. 

Bill Shorten, and his friends at the ABC and Fairfax did their best to prevent the repeal of the carbon tax. They are now determined to prevent Tony Abbott cleaning up the usual monetary mess left by Labor. 

But Labor left yet another mess, one they also don’t want cleaned up, and it’s becoming more urgent every day... Illegal Islamic immigration.

Labor clung to their “open borders” policy until the volume of illegal Islamic immigration became so dire Julia Gillard threw her hands in the air and allowed over 30,000 through the gates, unprocessed, unknown, on welfare, unable to work and we are forbidden from knowing who they are or where they are. 

They remain here, with idle hands making the devil’s work.

While Gillard is waxing lyrical on women’s issues and Rudd is conning upgrades to first class, the “cleaners” are being refused mops and disinfectant.

The current Islamic meltdown in North Africa and the Middle East is the very essence of deadly Islam at work, the combatants themselves say that, but we still aren’t allowed to say that.

Right now there are a further 153 aspiring illegal immigrants afloat on the Indian Ocean and in Australia’s care. They have warm beds, hot meals, cigarettes and health care but Fairfax reports today that the conditions aboard the border patrol vessel are “deplorable”. 

Yet the conditions must surely be either better than the Muslims claim they were escaping from... or they and Fairfax are lying.

A Muslim is no longer the immigrant of choice, particularly if they are illegal entrants and their most recent tactic is to claim to be of Indian or Sri Lankan heritage when these are actually Afghanis, Iranians and Iraqis and all are artfully coached by the smugglers.

The High Court will have a problem adjudicating on international maritime law outside even Australia’s jurisdiction. But this High Court has a penchant for adjudicating on anything and everything. 

[Under the Constitution, any single member of the Full Bench can decide if the High Court should hear or not hear any matter.] ... this is one of those matters that should not be heard.

Maritime law is clear and unambiguous: Under force majeure, the captain of any ship of any contracting nation responding to another vessel claiming distress, and displaying no national flag or a flag of convenience and which is intercepted outside the contracting nation’s contiguous or SAR zone (which this vessel is) has wide powers of discretion regarding the welfare of those seeking asylum. 

The rescuing vessel is also obliged to process the occupants where possible and disembark them at the nearest port of safe haven. 

And that’s exactly why our border patrol vessels intercept illegal immigrant boats outside Australia’s SAR zone where the nearest port of safe haven, on the basis of geographical proximity, will be either Sri Lanka or Indonesia, and not Christmas Island or New Guinea.

Therefore there seems no reason for any Australian vessel operating on the high seas, under international maritime law and where time is of the essence, to make any undertaking to Australia’s glacial High Court. 

Of course these illegal immigrants are not Hindu or Buddhist as they claim, they are Muslim and seen universally as nothing but trouble. 

And Australia is at last discovering just exactly how much trouble.
